Rules for FB/IG competitions

General rules for Facebook (FB) and Instagram (IG) competitions
("Rules")

1.      INTRODUCTORY PROVISIONS

1.1.  The organiser of the Instagram competition organised on the Instagram page https://www.instagram.com/lamax.electronics/ , respectively the Instagram account @truelife_czsk or the Facebook page https://www.facebook.com/LAMAX.electronics.cz.sk/ , respectively @lamax.electronics (hereinafter referred to as the "Competition") is elem6 s.r.o, Braškovská 308/15, Liboc, 161 00 Prague, ID No.: 242 32 335, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 200563 (hereinafter referred to as the "Promoter").

1.3.  The competition is open to natural persons over 18 years of age, who are fully capable of exercising their legal capacity and have a delivery address in the Czech Republic or the Slovak Republic (hereinafter referred to as the "Contestant").

1.4.  Employees of the Promoter and persons close to them are excluded from participation in the Competition. In addition, the Promoter has the right to exclude from the Contest, in particular, persons who do not comply with the terms and conditions of the Contest; persons who have obtained their participation by fraudulent means; persons who damage or may damage the Promoter; persons whose actions violate legal regulations or good manners; or for similar factual or legal reasons.

1.5.  The subject matter of these Rules is to set out the conditions under which Contestants may enter the Contest organised by the Promoter, as well as the conditions for the selection of winners and the delivery of prizes by the Promoter. By entering the Competition, the Contestant agrees to these Rules and undertakes to comply with them.

1.6.  The Promoter hereby declares that:

a)      The Competition is in no way sponsored, endorsed or administered by Meta as the operator of Instagram and Facebook and is in no way connected with the Competition;

b)      Meta, as the operator of Instagram and Facebook, shall have no rights or obligations to the Entrants under the Competition.

 

2.      GENERAL TERMS AND CONDITIONS OF PARTICIPATION IN THE CONTEST

2.1.  More detailed rules of the Contest, including the duration of the Contest, are always defined by the Organizer when the Contest is announced on the Organizer's Instagram or Facebook pages.

2.2.  The Promoter reserves the right to shorten, postpone, suspend, interrupt or cancel or unilaterally amend or supplement the rules of the Competition throughout the duration of the Competition by announcing the change on the Promoter's Instagram or Facebook pages without compensation.

 

3.      CONDITIONS OF PARTICIPATION IN THE COMPETITION

3.1.  Participation in the Contests is not conditional upon the purchase of the Promoter's goods or services.

3.2.  By participating in the Contest, the Contestant confirms that he/she has read these Rules and agrees to abide by them.

3.3.  Contestants will enter the Contest to win by responding to a Contest entry within each Contest according to the specific contest entry published by the Promoter in the post for each individual Contest. The essence of the Contests is generally to post a comment in response to a contest question or as an original response as specified by the Promoter.

3.4.  The Participant agrees that his/her comment, photo or other contribution used in the Contest may be published by the Promoter on its social networks or website.

 

4.      PRIZES, THEIR NOTIFICATION AND DELIVERY

4.1.  A panel of judges consisting of the Promoter's employees will select the winning entry from all responses entered as comments by the Entrants during the relevant period of each individual Competition. The specific selection and the method of selecting the winner may vary from one Competition to another. The Promoter will describe the exact method of selection for each individual Competition in the entry each time each Competition is announced.

4.2.  The prizes in the Competition and the number of prizes will be determined by the Promoter in the announcement of each individual Competition.

4.3.  Winners will be contacted by private message on their IG or FB profile to be notified of their prizes. The winners are also published on the Promoter's FB/IG page in a post announcing the winners of each individual Competition.

4.4.  Prizes are sent by the shipping company to the address provided by the Winner within 30 days of the end of the Contest, or the prize is delivered to the Winner in another way by prior agreement. The Promoter shall bear the costs incurred in transporting the prize to the Winner.

4.5.  If the Winner does not respond to a private message sent to him/her within 7 days of the Promoter's communication of the prize, his/her prize will be forfeited to the Promoter without compensation.

4.6.  The Promoter shall not be liable for any loss, damage or non-delivery of the prize from the time of dispatch. The Winner is not entitled to any other prize from the Promoter other than as stated above or to any other consideration. In the event that the prize is a specific product from the Promoter's e-shop, the goods are subject to the same warranty period as if purchased by an individual.

4.7.  The quality of the prizes is the responsibility of the Promoter, who will also handle any claims. Claims are governed by the Claims Policy, which is available here.

4.8.  The Promoter has the right not to award the prize and to cancel the Competition at any time.

 

5.      RULES FOR COMPETITION ENTRIES

5.1.  Contest entries must not be contrary to good morals, must not violate Czech or EU law and must not unlawfully interfere with the rights and legally protected interests of third parties. Nor may they be directed against the Promoter or its products. Such entries will be automatically excluded from the Competition.

5.2.  The Promoter shall be entitled at any time to review and subsequently disallow from the Contest and/or exclude from the Contest any entrants with an entry that the Promoter determines to be inappropriate for any reason stated above or otherwise, without any compensation and without any obligation to provide reasons for such determination. This also applies to entries that are technically unusable for the Competition. The Promoter therefore has the right to delete or not publish any entry or comment at any time.

 

6.      COPYRIGHT AND OTHER RIGHTS

6.1.  The Contestant agrees and grants a free license to the Organizer, without limitation in time, territory or quantity, to publish his/her entry, including the author's (Contestant's) personal or username, on the Internet and social networks in connection with the Contest. The Contestant also acknowledges that once posted, the entry may be disseminated on the internet outside the Promoter's will and the Promoter is not responsible for such dissemination.

6.2.  The Contestant warrants at all times that he/she is the exclusive copyright holder of the posted entry or that he/she has the consent of the respective copyright holder and all persons involved in the creation of the posted entry to use and license or sublicense the entry under the terms and to the extent set out in these Rules.

6.3.  Contestants are not entitled to any compensation (e.g. costs incurred) in connection with their participation in the Contest; the entry, commentary, or their further use by the Promoter in accordance with the Rules.

 

7.      DATA PROTECTION

7.1.  By submitting a comment as a reply to the Competition, the Contestant grants the Promoter express consent to the processing of the Contestant's personal data in the scope of name, surname, Facebook or Instagram name, e-mail address, telephone number, home address and other data entered during the Competition.

7.2.  The Promoter shall process the personal data submitted by the Contestant as a controller for the purposes of the Contestant's participation in the Contest and the delivery of the prize to the winners of the Contest.

7.3.  Personal data may be transferred to third parties in connection with the awarding, sending or delivery of prizes and to other entities involved in the delivery or transport of prizes in the Competition.

7.4.  All information on the processing of personal data as well as the rights of the Contestants as data subjects is contained in the Privacy Policy available on the Promoter's website.

7.5.  By participating in the Competition, the Contestant declares that he/she has read and understood the Privacy Policy.

7.6.  Consent to the processing of personal data may be withdrawn at any time by written notice sent to the Promoter's registered office.

 

8.      FINAL PROVISIONS

8.1.  The Promoter is entitled to check the accuracy of any data provided by the Contestant in the Contest at any time. In the event of false information or any other breach of these Rules by the Contestant, the Promoter shall be entitled not to allow the Contestant to participate in the Contest, or to exclude the Contestant from the Contest or not to issue the prize to the Contestant without any compensation. The Promoter's decision to take such action is final.

8.2.  The Promoter and the Contest Organiser are not responsible for the functionality of the Facebook and/or Instagram app, the delivery of messages or prizes. Any claims or objections are subject to the final decision of the Promoter.

These Facebook and Instagram Competition Rules are effective from 1 August 2025.
